REGULAR MEETING SEPTEMBER 17, 2002:



The regular meeting of the Common Council of the City of Morgantown was held in the Council Chambers on Tuesday, September 17, 2002, at 7:30 P.M.

PRESENT: Mayor Ron Justice, City Manager Dan Boroff, City Clerk Linda L. Little, Assistant City Manager Jeff Mikorski, City Attorney Steve Fanok and Councilmembers Ron Bane, Jim Manilla, Frank Scafella, Teresa Miller, Bill Byrne. (Florence Merow Absent).



The meeting was called to order by the Mayor.



APPROVAL OF MINUTES: Minutes from the regular meeting on September 3, 2002, were approved as printed.



CORRESPONDENCE:



Mayor Justice read a letter from MUB regarding stake holders meetings.



Mayor Justice read a proclamation for Constitution Week and presented it to Cindy Frich and Ann Van Voorhis.



Terri Cutright introduced new business people from downtown: Dale Sparks of All Pro Photography; Roland Pollander of Pella Window and Door; Jay Levine of Samantha Scott; and Lisa Novak of First Exchange Bank.

PUBLIC HEARING-AN ORDINANCE AMENDING SECTION 165.01 CITIZENS ADVISORY COMMITTEE:



Pursuant to a legal notice appearing in the Dominion Post, Mayor Justice called for a public hearing on the above referenced Ordinance.



There being no appearances or objections, Mayor Justice declared this hearing closed.



UNFINISHED BUSINESS:



AN ORDINANCE AMENDING SECTION 165.01 CITIZENS ADVISORY COMMITTEE: The following entitled Ordinance was presented for second reading:



AN ORDINANCE AMENDING SECTION 165.01 OF THE MORGANTOWN CITY CODE AS THE SAME APPLIES TO THE CITIZENS ADVISORY COMMITTEE, AND INCREASING THE NUMBER OF MEMBERS TO THAT COMMITTEE.



After discussion, motion by Miller, second by Byrne, to adopt the above entitled ordinance. Motion carried 6-0. (Merow Absent).

BOARDS AND COMMISSIONS:



By acclamation, Don West was appointed to the Ward and Boundary Commission.



PUBLIC PORTION:



Roy Johnson, 1302 Dunn Street, reported that the street is not a city street but private property and he wants to fence his property.



Mayor Justice replied that all parties involved will address the problem.



Cindy Frich, Publicity Chair, spoke about the Mason-Dixon Festival and invited Council and the public.



Milton Cohen, 1060 Ross Street, remarked on downtown development.



SPECIAL COMMITTEE REPORTS:

NEW BUSINESS:



DOWNTOWN RECRUITMENT:



Terri Cutright introduced Scott Smith, Vice President of Langholz Wilson. Mr. Scott reported on progress and answered questions from Council.



AN ORDINANCE CREATING THE UPPER HIGH STREET BUSINESS DISTRICT: The following entitled Ordinance was presented for first reading:



AN ORDINANCE CREATING THE UPPER HIGH STREET BUSINESS DISTRICT, WITHIN THE CORPORATE LIMITS OF THE CITY OF MORGANTOWN; BETWEEN WILLEY AND FAYETTE STREETS ALONG HIGH STREET, AND CREATING THE UPPER HIGH STREET BUSINESS IMPROVEMENT DISTRICT BOARD, AND ESTABLISHING PROCEDURES FOR CONTRACTING AND CONTROL OF FUNDS.

After discussion, motion by Byrne, second by Miller, to pass the above entitled ordinance to second reading. Motion carried 6-0. (Merow Absent).

A RESOLUTION APPLYING FOR AND ADMINISTERING GRANT FUNDS FOR MON RIVER TRAILS CONVERSANCY FOR NEEDED MAINTENANCE OF THE DECKERS CREEK TRAIL: The above entitled Resolution was presented for Council's approval:



After discussion, motion by Scafella, second by Miller, to pass the above entitled Resolution. Motion carried 6-0. (Merow Absent).



A RESOLUTION APPLYING FOR AND ADMINISTERING GRANT FUNDS FOR THE WEST VIRGINIA RAPTOR REHABILITATION CENTER FOR BUILDING MATERIALS TO BEGIN THE INITIAL PHASE OF DEVELOPMENT FOR THEIR NEW FACILITY: The above entitled Resolution was presented for Council's approval:



After discussion, motion by Scafella, second by Byrne, to pass the above entitled Resolution. Motion carried 6-0. (Merow Absent).



CITY MANAGERS REPORT:



INFORMATION:



Item No. 1:

Recently senior officials of WVU, the medical community, the County, the City's Police and Fire Departments, and City staff participated in a six hour workshop on weapons of mass destruction sponsored by the U.S. Department of Justice. This was a very productive event, particularly with regard to the cross-sharing of information. Principles of the current emergency operation plans were reinforced and some new features will be considered. In the near future several exercises may be scheduled to test these plans.



CITY CLERK'S REPORT:



The Hot Dog Sale raised $2,900 for the United Way.

STAFF ATTORNEY'S REPORT:



No Report.



REPORT FROM COUNCIL MEMBERS :



Councilor Bane: Councilor Bane listed the successful fund-raiser for Jack Roberts Park improvements, September Stride race for cystic fibrosis, the need for speeding enforcement on Willowdale again, and call the City Engineer about painting parking changes. Councilor Bane suggested Pace Tech employees for cleaning the Trail.



Councilor Manilla: Councilor Manilla noted no basketball nets at Jack Roberts Park and commented on the $2 million allocated by Economic Development.



Councilor Scafella: Councilor Scafella reported that Dorsey's Knob is visible again, the master plan for BOPARC will be on COW agenda, and the police are visible on Willowdale.



Councilor Miller: Councilor Miller will sign attendance papers for students.



Councilor Byrne: Councilor Byrne asked for an update on the South Point project.



City Manager Boroff replied the report will be out on Friday.



Councilor Byrne suggested Council talk with the judge about code enforcement penalties and asked what money is available from the state for building demolition. Councilor Byrne asked for an update on how permits are being facilitated.





Councilor Merow: Absent.



Mayor Justice: Mayor Justice forwarded a request to the City Manager from Woodburn Elementary. Mayor Justice mentioned that the Norwood Station Addition Dedication will be on Friday, September 27, 2002, at 2:00 p.m. Mayor Justice commented he had 2 phone calls from volunteers offering their help to clean-up around town. Mayor Justice announced that the next MPO meeting is September 25th, Dorsey Knob meeting will be on October 2, meeting at Bent Willeys on Friday, September 20th. Mayor Justice mentioned two issues with garbage on Richwood and Willey, also a street issue that I passed on to the City Manager.



EXECUTIVE SESSION:



Motion by Scafella, second by Bane to go into executive session pursuant to West Virginia

Code 6-9A-4-2 to discuss personnel matters with the following persons present: Council and City Manager. Time: 9:14 p.m.
