REGULAR MEETING AUGUST 6, 2002:
The regular meeting of the Common Council of the City of Morgantown was held in the Council Chambers on Tuesday, August 6, 2002, at 7:30 P.M.
PRESENT: Mayor Ron Justice, City Manager Dan Boroff, City Clerk Linda L. Little, Assistant City Manager Jeff Mikorski, City Attorney Steve Fanok and Councilmembers Ron Bane, Jim Manilla, Frank Scafella, Teresa Miller, Bill Byrne, Florence Merow.
The meeting was called to order by the Mayor.
APPROVAL OF MINUTES: Minutes from the regular meeting on July 16, 2002, & special meeting canvassing on July 23, 2002, were approved as printed.
CORRESPONDENCE:
Mike Nolty, WV Rural Water Association, presented a certificate to the City and MUB for flood relief.
Mayor Justice read a letter from the State Tax and Revenue Department Secretary, Brian Kastick, about Amendment 1.
PUBLIC HEARING-AN ORDINANCE REZONING TWO PARCELS OF REAL ESTATE IN THE FIFTH WARD:
Pursuant to a legal notice appearing in the Dominion Post, Mayor Justice called for a public hearing on the above referenced Ordinance.
There being no appearances or objections, Mayor Justice declared this hearing closed.
PUBLIC HEARING-AN ORDINANCE AMENDING THE FY 2002-2003 ANNUAL BUDGET OF THE CITY OF MORGANTOWN:
Pursuant to a legal notice appearing in the Dominion Post, Mayor Justice called for a public hearing on the above referenced Ordinance.
There being no appearances or objections, Mayor Justice declared this hearing closed.

BOARDS AND COMMISSIONS:
By acclamation, Dave Stelzig was appointed to the Human Rights Commission; Naomi Butler and Dr. Rudy Filed were reappointed to the Housing Authority; and Charles McEwuen was reappointed to the Parking Authority.
PUBLIC PORTION:
Gary Tannebaum, Blue Moose owner, suggested recycling downtown is needed.
Milton Cohen, 1060 Ross Street, spoke about parking garages and public parking.
SPECIAL COMMITTEE REPORTS:
Mayor Justice asked Byrne and Manilla to serve on the Umbrella Group for downtown recycling.

AN ORDINANCE AMENDING SECTION 363.08(d) OF THE TRAFFIC CODE OF THE CITY OF MORGANTOWN, AS THE SAME APPLIES TO HOURLY PARKING FEES IN MUNICIPAL OFF STREET PARKING LOTS: The following entitled Ordinance was presented for first reading:

A RESOLUTION AUTHORIZING THAT EFFECTIVE SEPTEMBER 1, 2002, THE HOURLY PARKING RATE FOR LOT C SHALL BE INCREASED FROM 25 CENTS TO 30 CENTS PER HOUR, AND ON OCTOBER 1, 2003 THE HOURLY PARKING RATE FOR LOT C SHALL BE INCREASED FROM 30 CENTS TO 50 CENTS PER HOUR : The above entitled Resolution was presented for Council's approval:

A RESOLUTION AUTHORIZING THAT THE CITY OF MORGANTOWN INCREASE THE PETTY CASH FUND FOR THE AIRPORT TO $500.00: The above entitled Resolution was presented for Council's approval:
After discussion, motion by Scafella, second by Byrne, to pass the above Resolution. Motion carried 6-1. (Merow voted NO).
A RESOLUTION AUTHORIZING THAT THE PRACTICE BE ADOPTED THAT THE DEPUTY MAYOR OR A DESIGNATED COUNCIL MEMBER WILL PRESIDE AT COMMITTEE OF THE WHOLE MEETINGS AT THE DISCRETION OF THE MAYOR: The above entitled Resolution was presented for Council's approval:
Motion by Scafella, second by Byrne, to pass the above Resolution. Motion carried 7-0.
A RESOLUTION AUTHORIZING THAT THE CITY AGREES TO THE CONDITIONS OF THE CONTRACT TO OBTAIN $10,000.00 FROM THE GOVERNOR'S COMMUNITY PARTNERSHIP PROGRAM TO IMPLEMENT A STATEWIDE HERITAGE TOURISM DEVELOPMENT PROGRAM: The above entitled Resolution was presented for Council's approval:
Motion by Byrne, second by Bane, to pass the above Resolution. Motion carried 7-0.
A RESOLUTION AUTHORIZING THE ENTRANCE INTO A CONTRACTUAL AGREEMENT WITH THE DIVISION OF CRIMINAL JUSTICE TO RECEIVE $153,381.00 FOR PROJECT 02-DC-09 PURSUANT TO PROVISIONS OF THE DRUG AND VIOLENT CRIME CONTROL PROGRAM: The above entitled Resolution was presented for Council's approval:
After discussion, motion by Byrne, second by Miller, to pass the above Resolution. Motion carried 7-0.
A RESOLUTION THAT THE MORGANTOWN CITY COUNCIL FULLY SUPPORT THE PASSAGE OF AMENDMENT ONE ON THE 2002 ELECTION BALLOT AND ENCOURAGE THE VOTERS OF WEST VIRGINIA TO VOTE YES ON AMENDMENT ONE.
After discussion, motion by Byrne, second by Miller, to pass the above Resolution. Motion carried 7-0.
A RESOLUTION TO AUTHORIZE EXECUTION OF A GRANT AGREEMENT FOR FUNDING CONFLICT RESOLUTION PROGRAMS IN FIVE ELEMENTARY SCHOOLS.
Motion by Miller, second by Bane, to table the above Resolution.
THE UPPER HIGH STREET IMPROVEMENT DISTRICT PLAN FOR DISTRICT IMPROVEMENTS:
Motion by Byrne, second by Bane, to approve the Upper High Street Improvement District Plan.

REPORT FROM COUNCIL MEMBERS :
Councilor Bane: Councilor Bane mentioned the rabies problem.
Councilor Manilla: Councilor Manilla commented on MUB work on University Ave., Beechurst sidewalk progress and citing landlords for garbage.
Councilor Scafella: Councilor Scafella requested garbage be on the COW agenda, made suggestions for traffic flow, and noted the Hart Field Coalition has been at every meeting and committee.
Councilor Miller: Councilor Miller commented on recycling in Dare County, NC, agreed that landlords should be responsible for garbage and suggested that our legislative representatives come to a meeting to discuss exterior maintenance.
Councilor Byrne: Councilor Byrne spoke on recycling, "blocking the box", and asked that exterior maintenance be on the COW agenda.
Councilor Merow: Councilor Merow commented on business recycling, future NETL construction plans, consultation with Hart Field Coalition, and deteriorated sidewalks and streets.
Mayor Justice replied that the WV DOH is responsible for those streets and sidewalks.
Councilor Merow noted that the garbage problem will never go away, an open sewer on Peninsula Blvd., and furniture on porches. Councilor Merow reported on the Trail (restrooms and turn around) and remarked on Milt Cohen against Adelphia in the past. Councilor Merow gave dates for the Mason/Dixon Festival and proposed a fee for out of city workers.
Mayor Justice: Mayor Justice suggested inviting Senators Prezioso and Hunter and the 4 delegates to a meeting and that city administration always brings plans to Council and we knew the Trail was to be rerouted. Mayor Justice commented on Adelphia's generosity with video equipment for the City and the schools. Adelphia bought out Century Cable after the negotiations were finished that Milton Cohen objected to at that time. Mayor Justice voiced a Woodburn Street complaint and thanked John Wilfong for his article on the Arts on the River Festival that Janie Ives chaired. Mayor Justice commented on Kids Day and an article on bicycles for transportation.
