REGULAR MEETING AUGUST 1, 2006:
The regular meeting of the Common Council of the City of Morgantown was held in the Council Chambers on Tuesday, August 1, 2006, at 7:30 P.M.
PRESENT: Mayor Ron Justice, City Manager Dan Boroff, Assistant City Manager Jeff Mikorski, City Clerk Linda Little, City Attorney Steve Fanok, and Council Members Ron Bane, Jim Manilla, Frank Scafella, Teresa Miller, Bill Byrne, Don Spencer.
APPROVAL OF MINUTES: Minutes from the regular meeting on July 18, 2006, were approved as printed.
CORRESPONDENCE:
Mayor Justice summarized a Neighborhood Network Week proclamation that Councilor Spencer will present, covered the Neighborhood Watch outing, and wished Mary Wimer a happy 100th birthday. Councilor Miller read a funding sources update letter from Danny Trejo of MAYSP.
PUBLIC HEARING-AN ORDINANCE APPROVING EASEMENTS TO WVU BOARD OF GOVERNORS FOR UNDERGROUND CHILLED WATER LINE IN THE STADIUM LOOP AREA:
Pursuant to a legal notice appearing in the Dominion Post, Mayor Justice called for a public hearing on the above referenced Ordinance.
There being no appearances or objections, Mayor Justice declared this public hearing closed.
PUBLIC HEARING-AN ORDINANCE AMENDING THE FY 2006-2007 ANNUAL BUDGET AS APPLIES TO THE COAL SEVERANCE FUND:
Pursuant to a legal notice appearing in the Dominion Post, Mayor Justice called for a public hearing on the above referenced Ordinance.
There being no appearances or objections, Mayor Justice declared this public hearing closed.
PUBLIC HEARING-AN ORDINANCE GRANTING A LICENSE TO THE WVU BOARD OF GOVERNORS FOR TEMPORARY STORAGE OF CONSTRUCTION MATERIALS IN THE STADIUM LOOP AREA:
Pursuant to a legal notice appearing in the Dominion Post, Mayor Justice called for a public hearing on the above referenced Ordinance.
There being no appearances or objections, Mayor Justice declared this public hearing closed.
UNFINISHED BUSINESS:
AN ORDINANCE APPROVING EASEMENTS TO WV BOARD OF GOVERNORS FOR UNDERGROUND CHILLED WATER LINE IN THE STADIUM LOOP AREA: The following entitled Ordinance was presented for second reading:
AN ORDINANCE APPROVING EASEMENTS BEING GRANTED TO THE WEST VIRGINIA BOARD OF GOVERNORS BY THE CITY OF MORGANTOWN FOR THE PLACEMENT OF AN UNDERGROUND CHILLED WATER LINE THROUGH REALTY OWNED BY THE CITY AND LOCATED ADJACENT TO UNIVERSITY AVENUE WITHIN WHAT IS COMMONLY KNOWN AS THE STADIUM LOOP AND ALSO UNDER UNIVERSITY AVENUE WHERE IT ABUTS THE FOREGOING CITY REALTY.
After discussion, motion by Scafella, second by Byrne, to adopt the above Ordinance. Motion carried 7-0.
AN ORDINANCE AMENDING THE FY 2006-2007 ANNUAL BUDGET AS APPLIES TO THE COAL SEVERANCE FUND: The following entitled Ordinance was presented for second reading:

After the City Manager’s explanation, motion by Miller, second by Manilla, to adopt the above Ordinance. Motion carried 7-0.
AN ORDINANCE APPROVING A LICENSE TO WEST VIRGINIA UNIVERSITY BOARD OF GOVERNORS FOR TEMPORARY STORAGE OF CONSTRUCTION MATERIALS AT THE STADIUM LOOP: The following entitled Ordinance was presented for second reading:
AN ORDINANCE APPROVING A LICENSE BEING GRANTED BY THE CITY OF MORGANTOWN TO THE WEST VIRGINIA UNIVERSITY BOARD OF GOVERNORS FOR THE TEMPORARY STORAGE OF CONSTRUCTION MATERIALS UPON REALTY OWNED BY THE CITY AND LOCATED ADJACENT TO UNIVERSITY AVENUE WITHIN WHAT IS COMMONLY KNOWN AS THE STADIUM LOOP.
Motion by Spencer, second by Miller, to adopt the above Ordinance. Motion carried 7-0.

PUBLIC PORTION:
Jessica Kalvitis, 7 ½ Pietro Street, spoke in support of re-routing truck traffic.
Dr. Bill Reger-Nash, WVU Community Medicine, showed a video of trucks at a downtown intersection in the morning and commented on quality of life issues.
James Giuliani, 256 Prairie Avenue, spoke of issues with the proposed 19-story building.
Jim Prete, 1136 Munsey Street, urged that the 19-story building be built well and commented on future zoning.

After the City Manager’s explanation, motion by Scafella, second by Byrne, to pass the above entitled Ordinance to second reading. Motion carried 7-0.
CITY MANAGERS REPORT:

Item No 1:
Last week, the City was notified that the Senate Appropriations Committee approved $2,300,000 to be budgeted for the Airport Access Road Project. Although much remains to be done for this approval to be included in the Federal Budget, it is a very significant milestone. This action is direct testimony to the experience, skill, and expertise of Senator Byrd and all that he has accomplished for the City of Morgantown.
Item No 2:
In the past week, we have had major air conditioning malfunctions also at the airport. It is an old, antiquated system actually made up of several parts that have been added over the years. With the current heat wave, the restaurant has been forced to close at the airport. The health department has concerns. The administrative offices there are really suffering under those conditions. Currently, under an emergency basis, we are getting proposals, not bids, for emergency repairs and replacements of this system and the expenses could be substantial; potentially five or six digits. At Council’s pleasure, we can have a couple of options. Once these proposals are collected, Council could call a special meeting and review those proposals and decide how you want to proceed, or you could leave it to the administrative staff to go ahead and get this problem remedied as quickly as possible, understanding the potential expense involved. I look for your direction on this issue.
After discussion, motion by Scafella, second by Byrne, to make a loan from the Capital Escrow Account to be reimbursed by the Airport. Motion carried 7-0.
CITY CLERK'S REPORT:
City Clerk Little spoke of the United Way Garage Sale, the hot dog sale and the WVML Conference.
CITY ATTORNEY'S REPORT:
No Report.
REPORT FROM COUNCIL MEMBERS):
Councilor Bane: Councilor Bane advised of a public meeting for the Kane-Core project on Thursday.
Councilor Manilla: Councilor Manilla commented on MountainFest expanding to four days and a dumpster problem under the Walnut Street Bridge.
Councilor Scafella: Councilor Scafella gave an update on the Senior Center and encouraged visitors to the Campus Advantage web site.
Councilor Miller: Councilor Miller attended the Gina Stewart Benefit and wished Gina the best of luck and asked if a question and answer forum could be on the City web site.
Councilor Byrne: Councilor Byrne requested opening another traffic lane on High Street for Friday through Sunday; commented on trash downtown and inconsistent microphones; thanked Dr. Reger-Nash for video; discussed the bonds for the Kane-Core project and the Campus Advantage reputation; and urged zoning redevelopment and the future of parking.
Councilor Spencer: Councilor Spencer asked the City Manager to present the Planner’s information on the Richwood Avenue project; spoke of the airport road; requested COW discussion on 4-bedroom units in Sunnyside and “green” buildings; commended Police on MountainFest, the neighborhoods on Nights Out, and the truck video.
Mayor Justice: Mayor Justice commented on MountainFest and local hospitality; commended Gina’s spirits; suggested removable speed bumps and other issues on the COW; noted presenting the Square at Falling Run to the Economic Grant Committee; discussed the importance of the overlay zoning map; and recommended making decisions based on available information and using all resources.
