REGULAR MEETING JUNE 7, 2005:
The regular meeting of the Common Council of the City of Morgantown was held in the Council Chambers on Tuesday, June 7, 2005, at 7:30 P.M.
PRESENT: Mayor Ron Justice, City Manager Dan Boroff, City Clerk Linda Little, Assistant City Manager Jeff Mikorski, City Attorney Steve Fanok, and Council Members Ron Bane, Jim Manilla, Frank Scafella, Teresa Miller, Bill Byrne, Don Spencer.
The meeting was called to order by the Mayor.
APPROVAL OF MINUTES: Minutes from the regular meeting on May 17, 2005, were approved as printed and the special meeting minutes of May 31, 2005, were approved as amended.
CORRESPONDENCE:
Mayor Justice announced future meetings and events and noted the new ice rink floor and the riverfront development article in the State Journal.
PUBLIC HEARING-AN ORDINANCE AMENDING THE FY 2004-2005 ANNUAL BUDGET:
Pursuant to a legal notice appearing in the Dominion Post, Mayor Justice called for a public hearing on the above referenced Ordinance.
There being no appearances or objections, Mayor Justice declared this public portion closed.
UNFINISHED BUSINESS:
AN ORDINANCE AMENDING THE FY 2004-2005 ANNUAL BUDGET: The following entitled Ordinance was presented for second reading.
AN ORDINANCE AMENDING THE FY 2004-2005 ANNUAL BUDGET OF THE CITY OF MORGANTOWN AS SHOWN IN THE REVISED BUDGET ATTACHED HERETO AND MADE A PART OF THIS ORDINANCE AS THE SAME APPLIES TO THE GENERAL FUND.
Motion by Scafella, second by Miller, to adopt the above Ordinance. Motion carried 7-0.

PUBLIC PORTION:
Charlene Marshall, 1010 Ashton Estates, explained her absence at the legislative meeting and commented on the City Manager article and the State Journal article.

NEW BUSINESS:
AN ORDINANCE AMENDING SECTIONS 365.03 AND 365.99, AND ADDING A NEW SECTION 365.12 TO THE TRAFFIC CODE AS APPLY TO OFF STREET PARKING FACILITIES: The following entitled Ordinance was presented for Council's approval.
AN ORDINANCE AMENDING SECTIONS 365.03 AND 365.99 OF THE TRAFFIC CODE OF THE CITY OF MORGANTOWN, AND ADDING A NEW SECTION 365.12 THERETO, AS THE SAME APPLY TO ILLEGAL PARKING AND PENALTIES REGARDING MUNICIPAL OFF STREET PARKING FACILITIES.
After discussion, motion by Byrne, second by Bane, to pass the above Ordinance to second reading. Motion carried 7-0.
AN ORDINANCE AMENDING SECTIONS 767.02 AND 767.08 OF THE BUSINESS AND TAXATION CODE AS APPLY TO HOTEL OCCUPANCY TAX: The following entitled Ordinance was presented for Council's approval.
AN ORDINANCE AMENDING SECTIONS 767.02 AND 767.08 OF THE BUSINESS AND TAXATION CODE OF THE CITY OF MORGANTOWN AS THE SAME APPLY TO THE AMOUNT OF THE HOTEL OCCUPANCY TAX AND ALLOCATION OF SUCH MONEY RECEIVED BY THE CITY.
After discussion, motion by Spencer, second by Bane, to pass the above Ordinance to second reading. Motion carried 7-0.
AN ORDINANCE ESTABLISHING RATES OF COMPENSATION FOR CITY EMPLOYEES FOR FY 2005-2006: The following entitled Ordinance was presented for Council's approval.
AN ORDINANCE ESTABLISHING THE RATES OF COMPENSATION FOR CITY OF MORGANTOWN EMPLOYEES FOR THE FISCAL YEAR 2005-2006.
After discussion, motion by Scafella, second by Bane, to pass the above Ordinance to second reading. Motion carried 7-0.
AN ORDINANCE AMENDING LONGEVITY PAY, SHIFT DIFFERENTIAL, AND HAZARDOUS DUTY PAY SECTIONS OF THE PERSONNEL RULES: The following entitled Ordinance was presented for Council's approval.
AN ORDINANCE AMENDING SECTIONS III-1(B)(LONGEVITY PAY), III-3(B)(SHIFT DIFFERENTIAL), AND III-4(HAZARDOUS DUTY PAY) OF THE PERSONNEL RULES OF THE CITY OF MORGANTOWN BY INCREASING THE MONETARY AMOUNTS WITHIN EACH.
Motion by Byrne, second by Bane, to pass the above Ordinance to second reading. Motion carried 7-0.
AN ORDINANCE AUTHORIZING A LEASE OF THE STADIUM LOOP OF UNIVERSITY AVENUE TO THE WEST VIRGINIA BOARD OF GOVERNORS : The following entitled Ordinance was presented for Council's approval.
AN ORDINANCE AUTHORIZING THE CITY OF MORGANTOWN TO LEASE CITY REALTY, WITHIN WHAT IS KNOWN AS THE STADIUM LOOP OF UNIVERSITY AVENUE TO THE WEST VIRGINIA UNIVERSITY GOVERNORS FOR USE AS A PARKING LOT.
After discussion, motion by Bane, second by Scafella, to pass the above Ordinance to second reading. Motion carried 7-0.
AN ORDINANCE AMENDING SECTION 149.02 OF THE ADMINISTRATIVE CODE INCREASING THE BOARD OF PARK AND RECREATION COMMISSIONERS FROM 5 TO 7 MEMBERS: The following entitled Ordinance was presented for Council's approval.
AN ORDINANCE AMENDING SECTION 149.02 OF THE ADMINISTRATIVE CODE OF THE CITY OF MORGANTOWN AND INCREASING THE MEMBERSHIP ON THE CITY'S BOARD OF PARK AND RECREATION COMMISSIONERS FROM 5 TO 7 MEMBERS.
After discussion, motion by Miller, second by Manilla, to pass the above Ordinance to second reading. Motion carried 7-0.
RESOLUTION TO APPROVE THE 2005-2006 MORGANTOWN MUNICIPAL AIRPORT FUND AND AIRPORT IMPROVEMENT FUND BUDGET: The above entitled Resolution was presented for Council's approval.
After discussion, motion by Byrne, second by Scafella, to approve the above entitled Resolution. Motion carried 7-0.
RESOLUTION TO APPROVE THE REVISION OF THE 2004-2005 MORGANTOWN MUNICIPAL AIRPORT BUDGET: The above entitled Resolution was presented for Council's approval.
After discussion, motion by Miller, second by Scafella, to approve the above entitled Resolution. Motion carried 6-1. (Spencer voted NO.)
RESOLUTION TO EXECUTE THE $250,000 GRANT AGREEMENT FOR DORSEY'S KNOB PARK FROM THE LAND AND WATER CONSERVATION FUND: The above entitled Resolution was presented for Council's approval.
Motion by Miller, second by Scafella, to approve the above entitled Resolution. Motion carried 7-0.
CITY MANAGERS REPORT:
NEW BUSINESS:
Item No. 1:
Attached you will find a request to help finance a special Rail Trail project in conjunction with other area governments. Given the regional benefits the project will generate, I recommend that the City help fund the project with $5,000 from the Capital Escrow Account to construct a Community Built Playground at Edith Barill Riverfront Park.
After discussion, motion by Scafella, second by Byrne, to allocate $5,000 to the Community Built Playground. Motion carried 7-0.
Item No. 2:
The second attachment is a request for a Fair Permit to support the annual Chicken Wing Cook-Off at the Mountaineer Mall on August 20, 2005. Given the merits of the event, I recommend that the permit be granted.
Motion by Miller, second by Scafella, to grant the Fair Permit. Motion carried 7-0.
CITY CLERK'S REPORT:
City Clerk Little gave a reminder of the pepperoni roll fund-raiser.
CITY ATTORNEY'S REPORT:
No Report.
REPORT FROM COUNCIL MEMBERS:
Councilor Bane: Councilor Bane discussed the Hite Street wall problem, future WVUH Magnet certification; thanks to MUB for Dorsey Avenue drains and the Youth Commission retreat was incredible.
City Manager Boroff replied that the Hite Street wall is private property but a building permit has now been issued and explained the permit process.
Councilor Manilla: Councilor Manilla requested street sweeping in Sabraton and Marilla bridge status; asked about lights and sidewalks for Sabraton Rt. 7; requested a letter to WVML re:success with local legislative meeting; and commented on the airport tour.
Mayor Justice responded on the Marilla bridge study status and noted that Main Street cannot extend to that area and suggested a local association be formed.
Councilor Scafella: No Report.
Councilor Miller: Councilor Miller commented on disreputable housing as a state-wide issue.
Councilor Byrne: Councilor Byrne discussed rental encroachment into owner occupied neighborhoods and potential solutions.
Councilor Spencer: Councilor Spencer commented on Councilor Scafella's return, Ed Shockey's death, Special Olympics; requested more air quality monitors; and announced meetings on tree ordinance review and the Collins Ferry sidewalk.
Mayor Justice: Mayor Justice noted evaluations are due; discussed the Youth Commission, Special Olympics, and the Ms. WV pageant; asked for review of city-wide 25 mph speed limit; suggested Mark Fenton as a Sabraton contact and informed Council of BOPARC correspondence about the Dorsey Knob deck.
EXECUTIVE SESSION: Motion by Byrne, second by Miller, to go into an executive session pursuant to Section 6-9A-4-6 of the West Virginia Code in order to discuss personnel matters with the following persons present: Mayor Ron Justice, Council Members and City Manager. Time 9:00 p.m.
