REGULAR MEETING MARCH 5, 2002:
The regular meeting of the Common Council of the City of Morgantown was held in the Council Chambers on Tuesday, March 5, 2002, at 7:30 P.M.
PRESENT: Deputy Mayor Ron Justice, City Manager Dan Boroff, City Clerk Linda L. Little, Assistant to the City Manager Jeff Mikorski, City Attorney Steve Fanok and Councilmembers Ron Bane, Jim Manilla, Teresa Miller, Bill Byrne, Florence Merow. (Mayor Frank Scafella Absent).
The meeting was called to order by the Deputy Mayor.
APPROVAL OF MINUTES: Minutes from the regular meeting on February 19, 2002, were approved as printed.
CORRESPONDENCE:
Deputy Mayor Justice presented a proclamation to Christy Shaffer, of the WVU Student Government Association, for Safety Week and read a proclamation for Women's History Month.
Deputy Mayor Justice read a letter from the DOH regarding Beechurst Avenue.
BOARDS AND COMMISSIONS:
By acclamation, Jill Kriesky, Dr. Anna Elfenbein and Vicki Shaffer were appointed to the
Human Rights Commission.
By acclamation, Harold Moore was appointed to the Police Civil Service Commission.
PUBLIC PORTION:
John Duarte, 460 Grove Street, commented on and questioned budget items.
Phil Shuman, 250 Kingwood Street, thanked Council, people and businesses for contributing to the MHS drama students' trip to the national competition.
George Longenecker, WV Botanic Garden, requested community involvement and thanked Council for supporting the master plan.
Bill Wonderlin, 1353 Headlee Avenue, spoke on border area planning.
Christy Shaffer, BOG, invited Council to Safety Week at the Mountainlair.
Linda Bagby, 532 Kiwanis Avenue, spoke on behalf of the WV Botanical Garden and requested community involvement.
Jon Gever, 505 Linden Street, urged adoption of the resolution for joint City/County planning.
NEW BUSINESS:
AN ORDINANCE ADOPTING THE ANNUAL BUDGET FOR FISCAL YEAR 2002-2003: The following entitled Ordinance was presented for first reading:
AN ORDINANCE ADOPTING THE ANNUAL BUDGET OF THE CITY OF MORGANTOWN FOR FISCAL YEAR 2002-2003.
After discussion, motion by Byrne, second by Manilla, to pass the above entitled ordinance to second reading. Motion carried 6-0. (Scafella Absent).
A SECOND AMENDATORY ORDINANCE PROVIDING FOR THE AMENDMENT OF THE DEFINITION OF "THE PROJECT": The following entitled Ordinance was presented for first reading:
A SECOND AMENDATORY ORDINANCE PROVIDING FOR THE AMENDMENT OF THE DEFINITION OF "THE PROJECT" AS SAID TERM IS DESCRIBED IN THE ORDINANCE AUTHORIZING THE ISSUANCE OF THE COMBINED WATERWORKS AND SEWERAGE SYSTEM REVENUE BONDS, SERIES 2000 A (WEST VIRGINIA SRF PROGRAM):, AND COMBINED WATERWORKS AND SEWERAGE SYSTEM REVENUE BONDS, SERIES 2000B (WEST VIRGINIA INFRASTRUCTURE FUND), OF THE CITY OF MORGANTOWN, AS PREVIOUSLY AMENDED BY AN AMENDATORY ORDINANCE ENACTED BY THE CITY COUNCIL OF THE CITY ON APRIL 3, 2001.

CONSIDERATION OF APPROVAL OF A RESOLUTION CALLING UPON THE COUNTY COMMISSION TO JOIN IN A PRODUCTIVE, FRUITFUL PARTNERSHIP TO ESTABLISH A COMPREHENSIVE PLAN FOR DEVELOPMENT OF OUR COMMUNITY AND FURTHERMORE TO PUT IN PLACE PRACTICAL, SMART GROWTH PRINCIPLED LAND USE CONTROLS TO IMPLEMENT THIS PLAN: The above entitled Resolution was presented for Council's approval:
After discussion and approval of additional language suggested by Merow, motion by Manilla, second by Byrne, to pass the above resolution. Motion carried 6-0. (Scafella Absent).
CONSIDERATION OF APPROVAL OF A RESOLUTION THAT CITY COUNCIL REQUESTS THAT STATE DELEGATES FROM THE 44TH DISTRICT, THE SENATE REPRESENTATIVES FROM THE 13TH DISTRICT WORK WITH ALL POSSIBLE STATE FUNDING SOURCES TO PROVIDE THE CITY OF MORGANTOWN WITH A DOLLAR FOR DOLLAR MATCH TO COMPLETE AN ENTIRE RENOVATION OF THE STREET AND STREETSCAPE OF SOUTH WALNUT STREET AND THE ENTRANCE TO HAZEL RUBY MCQUAIN PARK: The above entitled Resolution was presented for Council's approval:
After discussion, motion by Byrne, second by Miller, to pass the above resolution. Motion carried 6-0. (Scafella Absent).
CONSIDERATION OF APPROVAL OF A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT WITH WEST VIRGINIA DEPARTMENT OF TRANSPORTATION, DOH, FOR $264,760 SO AS TO PROCEED WITH THE REVITALIZATION OF CLAY STREET LOCATED WITHIN THE WHARF DISTRICT: The above entitled Resolution was presented for Council's approval:
After discussion, motion by Miller, second by Byrne, to pass the above resolution. Motion carried 5-1. (Scafella Absent, Manilla voted NO).
CITY MANAGER'S REPORT:
NEW BUSINESS:
ITEM NO. 1:
Attached you will find the bid results for a ½ ton 4x4 pick-up for the Public Works Department. I concur with the Public Works Director's comments and recommend the contract be awarded to the low bidder Matheny Motors for $18, 595.
Motion by Merow, second by Miller, to award the contract to Matheny Motors for $18,595.
Motion carried 6-0. (Scafella Absent).
ITEM NO. 2:
As discussed at the Committee of the Whole and as per the direction of the State Supreme Court, I recommend that City Council authorize a Special Election to be held on July 23, 2002, to decide the matter of collective bargaining for City employees.
After discussion, motion by Miller, second by Byrne, to authorize a Special Election for July 23, 2002. Motion carried 6-0. (Scafella Absent).
ITEM NO. 3:
The second attachment is the proposed street paving list and contingency list for 2002. $275,000 is available for this program.
After discussion, motion by Bane, second by Merow, to approve the street paving list and the contingency list (with 2 additions) for $275,000. Motion carried 6-0. (Scafella Absent).
ITEM NO. 4:
The last attachment is a suggested change order for the Hazel Ruby McQuain Park contract to add lighting for the Deckers Creek Bridge at a cost of $5,121. I recommend the order be approved and funded from the Capital Escrow Account contingency line.
Motion by Miller, second by Bane, to add lighting for the Deckers Creek Bridge for $5,121. Motion carried 6-0. (Scafella Absent).

REPORT FROM COUNCIL MEMBERS :
Councilor Bane: Councilor Bane thanked the City Manager and Engineering Dept. for checking some things out.
Councilor Manilla: Councilor Manilla suggested a better procedure is needed for allocating money to charities and agencies. After discussion, Manilla, Merow, and Miller formed a committee for research. Councilor Manilla requested a DOH representative at the April COW to discuss short term traffic fixes and noted the coming of the AAU Basketball Tournament. Councilor Manilla asked that Megan King - Johnson of Arts Monongahela be at the March COW.
Councilor Miller: Councilor Miller is glad the tournament is coming and hopes it turns into an annual event to bring in money to the City. Councilor Miller commented on Mr. Wonderlin's statements and believes that area is asking for annexation.
Councilor Byrne: Councilor Byrne noted that litter in Sunnyside is still bad, lower Brockway still looks terrible and hard wired smoke detectors are not in place yet.
Councilor Merow: Councilor Merow is happy the DOH will do a Beechurst design study and commented on Census figures. Councilor Merow thanked the City Manager for his work on the budget.
Mayor Scafella: ABSENT.
Deputy Mayor Justice: Deputy Mayor Justice commented on the Basketball Tournament and asked for volunteers in July. The Sabraton Businesses and COMM/PACT will meet March 14, Community clean up will be March 13. The TEA-21 grant committee for sidewalks and power lines will meet March 14. Deputy Mayor Justice noted blowing litter and cinders on Willey Street and the Downtown Task Force for curbs and sidewalks will meet April 12. Deputy Mayor Justice echoed thanks to the City Manager, mentioned problems other cities are having, and noted that evaluations for the City Manager, City Clerk and Municipal Judge will be March 19.
