REGULAR MEETING FEBRUARY 21, 2006:
The regular meeting of the Common Council of the City of Morgantown was held in the Council Chambers on Tuesday, February 21, 2006, at 7:30 P.M.
PRESENT: Mayor Ron Justice, City Manager Dan Boroff, City Clerk Linda Little, City Attorney Steve Fanok, Assistant City Manager Jeff Mikorski, and Council Members Ron Bane, Jim Manilla, Frank Scafella, Teresa Miller, Bill Byrne, Don Spencer.
The meeting was called to order by the Mayor.
APPROVAL OF MINUTES: Minutes from the regular meeting on February 7, 2006, were approved as printed.
CORRESPONDENCE:
Mayor Justice recognized Stanley Wearden and Marca Paparozzi for their many years of service on the Planning Commission. Mayor Justice passed around photos for Council to review a project that the Airport will be doing in the near future.
PUBLIC HEARING-AN ORDINANCE CONSOLIDATING FAA AGREEMENTS AT THE AIRPORT:
Pursuant to a legal notice appearing in the Dominion Post, Mayor Justice called for a public hearing on the above referenced Ordinance.
There being no appearances or objections, Mayor Justice declared this public hearing closed.
PUBLIC HEARING-AN ORDINANCE ANNULLING A 25' RIGHT-OF-WAY KNOWN AS RAINY STREET IN THE THIRD WARD:
Pursuant to a legal notice appearing in the Dominion Post, Mayor Justice called for a public hearing on the above referenced Ordinance.
There being no appearances or objections, Mayor Justice declared this public hearing closed.
PUBLIC HEARING-AN ORDINANCE AUTHORIZING THE CITY OF MORGANTOWN TO EXECUTE A DEED GRANTING THE DOH A RIGHT-OF-WAY ACROSS A BRIDGE LOCATED ON DUG HILL ROAD:
Pursuant to a legal notice appearing in the Dominion Post, Mayor Justice called for a public hearing on the above referenced Ordinance.
There being no appearances or objections, Mayor Justice declared this public hearing closed.
UNFINISHED BUSINESS:
AN ORDINANCE CONSOLIDATING FAA AGREEMENTS AT THE AIRPORT : The following entitled Ordinance was presented for second reading.
AN ORDINANCE AUTHORIZING THE CITY OF MORGANTOWN TO EXECUTE AN AGREEMENT WITH THE FEDERAL AVIATION ADMINISTRATION (FAA) WHICH CONSOLIDATES SEVEN SEPARATE FAA LEASE AGREEMENTS AT THE MORGANTOWN MUNICIPAL AIRPORT INTO ONE MASTER AGREEMENT.
Motion by Scafella, second by Byrne, to adopt the above Ordinance. Motion carried 7-0.
AN ORDINANCE ANNULLING A 25' RIGHT-OF-WAY KNOWN AS RAINY STREET IN THE THIRD WARD: The following entitled Ordinance was presented for second reading.
AN ORDINANCE VACATING, ABANDONING AND ANNULLING A 25' WIDE RIGHT-OF-WAY KNOWN AS RAINY STREET, EXTENDING AND RUNNING A DISTANCE OF APPROXIMATELY SEVEN HUNDRED AND SEVENTY-EIGHT FEET BETWEEN FALLING RUN ROAD AND AN UNNAMED ALLEY, IN THE THIRD WARD OF THE CITY OF MORGANTOWN, MONONGALIA COUNTY, WEST VIRGINIA, NOT USED NOR USEFUL FOR STREET PURPOSES.
Motion by Miller, second by Bane, to adopt the above Ordinance. Motion carried 7-0.
AN ORDINANCE AUTHORIZING THE CITY OF MORGANTOWN TO EXECUTE A DEED GRANTING THE DOH A RIGHT-OF-WAY ACROSS A BRIDGE LOCATED ON DUG HILL ROAD: The following entitled Ordinance was presented for second reading.
AN ORDINANCE AUTHORIZING THE CITY OF MORGANTOWN, AS GRANTOR, TO EXECUTE A DEED GRANTING THE WEST VIRGINIA DEPARTMENT OF HIGHWAYS, GRANTEE, A RIGHT-OF-WAY FOR PUBLIC ROAD PURPOSES OVER, THROUGH, ACROSS AND UPON A BRIDGE WHICH IS LOCATED ON DUG HILL ROAD WITHIN THE CITY OF MORGANTOWN.
Motion by Scafella, second by Bane, to adopt the above Ordinance. Motion carried 7-0.
BOARDS AND COMMISSIONS:
By acclamation, Barry Dickson was appointed to the BOCA Code Appeals Board and Larry Calemine reappointed to the Transit Authority.
PUBLIC PORTION:
Shelly Martin, Monongalia County Health Department, gave statistics and an invitation to the Regional Pandemic Flu Summit.
There being no more appearances or objections, Mayor Justice declared this public portion closed.
SPECIAL COMMITTEE REPORTS:
Mayor Justice announced the Solid Waste Task Force report will be on the COW agenda in March.
NEW BUSINESS:
AN ORDINANCE ANNULLING A 30' RIGHT-OF-WAY KNOWN AS DALLAS STREET IN THE FIFTH WARD: The above entitled Ordinance was presented for first reading.
AN ORDINANCE VACATING, ABANDONING , AND ANNULLING A 30' WIDE RIGHT-OF-WAY KNOWN AS DALLAS STREET (FORMERLY OAK STREET), EXTENDING AND RUNNING A DISTANCE OF APPROXIMATELY EIGHTY-NINE FEET BETWEEN BAIRD STREET AND FOREST AVENUE, IN THE FIFTH WARD OF THE CITY OF MORGANTOWN, MONONGALIA COUNTY, WEST VIRGINIA, NOT USED NOR USEFUL FOR STREET PURPOSES.
After the City Manager’s explanation, motion by Miller, second by Scafella, to pass the above Ordinance to second reading. Motion carried 7-0.
CITY MANAGERS REPORT:

Item No. 1:
I am very pleased to report that the Assistant City Manager Jeff Mikorski has received the International City/County Management Association Credentialed Manager designation. Jeff is now one of the 880 local government management professionals who are credentialed by the Association’s program. This designation is not lightly made. To earn it, the candidate must have achieved significant experience as a senior management executive in local government, earned a college degree, and demonstrated a strong commitment to high standards of integrity, lifelong learning, and professional development. This is a significant achievement that speaks well of Jeff and the City of Morgantown.
Item No. 2:
Proposed budgets for the General Fund, Coal Severance Fund, and the Capital Escrow Account will be presented for fiscal year 2006-2007.
NEW BUSINESS:
Item No. 1:
Attached you will find materials reporting bid results for the Marina Grant Project. I agree with the comments made and recommend that the contract be awarded to the low bidder March Westin Company for a cost not to exceed $3,200,000.
The rules were suspended to allow Rich Lane to give an update. Motion by Manilla, second by Spencer, that the Marina Grant Project be awarded to March Westin for a cost not to exceed $3,200,000. Motion carried 7-0.
Item No. 2:
The second attachment is a memo from the Fire Department reporting the bid results for fire fighting protective gear. Based upon the information presented, I recommend that the bid be awarded to Ashby Fire Equipment Company for the Morning Pride gear and to Mason-Dixon Fire Equipment LLC for the Janesville gear for minimum amounts of $22,280 and $19,781.15 respectively.
Motion by Scafella, second by Bane, to accept the recommendations for awarding bids of $22,280 and $19,781. Motion carried 7-0.
Item No. 3:
The third attachment is another memo from the Fire Department reporting bid results for the purchase of radio equipment. Based upon the information provided, I recommend that the bids be awarded to Continental for the portable radio equipment at a cost of $617.14, and to O’Neal for the base equipment at a cost of $19,491.00.
Motion by Spencer, second by Bane, to approve. Motion carried 7-0.

REPORT FROM COUNCIL MEMBERS:
Councilor Bane: Councilor Bane had questions about Mountaineer Gardens, time commitment to Sunnyside Up and the Public Theatre.
Councilor Manilla: No Report.
Councilor Scafella: No Report.
Councilor Miller: Councilor Miller announced the Evansdale NHA meeting and congratulated Jeff Mikorski.
Councilor Byrne: Councilor Byrne addressed the revitalization and zoning changes for Sunnyside Up development.
Councilor Spencer: Councilor Spencer discussed Community Development Block Grant cuts and changes, transportation costs versus city housing costs, sidewalk planning issues and a Grant Avenue extension, and the Longview public hearing.
Mayor Justice: Mayor Justice announced a Solid Waste Task Force meeting and mentioned a BFI problem on Richwood Avenue today.
