REGULAR MEETING AUGUST 2, 2005:



The regular meeting of the Common Council of the City of Morgantown was held in the Council Chambers on Tuesday, August 2, 2005, at 7:30 P.M.

PRESENT: Mayor Ron Justice, City Manager Dan Boroff, City Clerk Linda Little, Assistant City Manager Jeff Mikorski, City Attorney Steve Fanok, and Council Members Frank Scafella, Teresa Miller, Bill Byrne, Don Spencer. (Jim Manilla and Ron Bane Absent.)



The meeting was called to order by the Mayor.



APPROVAL OF MINUTES: Minutes from the regular meeting on July 19, 2005, were approved as printed.



CORRESPONDENCE:



Mayor Justice summarized letters: two in support of the Regions Air proposal, congratulations from Senator Rockefeller for the Tree City USA Award; from Dr. Majumder for the special celebration of Achievements, TugBoat Depot thank you for Community Built Playground support; announced the legislative interims and remarked on the MountainFest weekend.



PUBLIC HEARING-AN ORDINANCE AMENDING THE FY 2005-2006 ANNUAL BUDGET AS APPLIES TO THE COAL SEVERANCE FUND:



Pursuant to a legal notice appearing in the Dominion Post, Mayor Justice called for a public hearing on the above referenced Ordinance.



There being no appearances or objections, Mayor Justice declared this public hearing closed.



UNFINISHED BUSINESS:



AN ORDINANCE AMENDING THE FY 2005-2006 ANNUAL BUDGET AS APPLIES TO THE COAL SEVERANCE FUND: The following entitled Ordinance was presented for second reading.

AN ORDINANCE AMENDING THE FY 2005-2006 ANNUAL BUDGET OF THE CITY OF MORGANTOWN AS SHOWN IN THE REVISED BUDGET ATTACHED HERETO AND MADE A PART OF THIS ORDINANCE AS THE SAME APPLIES TO THE COAL SEVERANCE FUND.



Motion by Scafella, second by Byrne, to adopt the above Ordinance. Motion carried 5-0. (Bane and Manilla Absent.)

SPECIAL COMMITTEE REPORTS:



Councilor Spencer gave updates on Beechurst and Patteson Drive crosswalks and summarized a USA Today article on tree ordinances.



NEW BUSINESS:



AN ORDINANCE AMENDING SECTION 5-ZONING ORDINANCE ADDING 60.1; AMENDING 17 & 19-E-2 DEFINING AND REGULATING VIDEO LOTTERY: The following entitled Ordinance was presented for Council's approval.



AN ORDINANCE AMENDING SECTION 5 OF THE ZONING ORDINANCE OF THE CITY OF MORGANTOWN BY ADDING 60.1; AMENDING SECTION 17; AND AMENDING SECTION 19-E-2, AS THE SAME APPLY TO THE DEFINING AND REGULATING VIDEO LOTTERY AND GAMING ESTABLISHMENTS.



After discussion, motion by Miller, second by Spencer, to pass the above Ordinance to second reading. Motion carried 5-0. (Bane and Manilla Absent.)



AN ORDINANCE AMENDING THE FY 2005-2006 ANNUAL BUDGET AS APPLIES TO THE GENERAL FUND: The following entitled Ordinance was presented for Council's approval.

CONSIDERATION OF APPROVAL 0F A RESOLUTION TO MAKE APPLICATION FOR A CONTRACTUAL AGREEMENT WITH THE DIVISION OF CRIMINAL JUSTICE TO RECEIVE GRANT FUNDS OF $112, 000 FOR SALARIES TO CONTINUE THE MULTI-JURISDICTIONAL DRUG AND VIOLENT CRIME TASK FORCE: The above entitled Resolution was presented for Council's approval.

CITY MANAGERS REPORT:



NEW BUSINESS:

Item No. 1:

Attached you will find a memo from the Fire Chief reporting bid results for uniform clothing. I agree with his comments and recommend that the contract be awarded to the low bidder Galls Inc. for an aggregate unit cost of $839.31.



Motion by Scafella, second by Miller, to award the bid to the low bidder, Galls Inc., for uniform clothing for the Fire Department. Motion carried 5-0. (Bane and Manilla Absent.)





Item No. 2:

Recently the Monongalia County Solid Waste Authority has suggested that the City substitute #1 clear plastic for colored glass in its recycling program. I agree with the Authority's reasoning and recommend that the substitution be effected with BFI.



After discussion, motion by Byrne, second by Scafella, to approve substituting clear plastic for colored glass in the recycling program. Motion carried 5-0. (Bane and Manilla Absent.)

CITY CLERK'S REPORT:



City Clerk Little announced the annual United Way Garage Sale and Hot Dog Sale events.



CITY ATTORNEY'S REPORT:



No report.



REPORT FROM COUNCIL MEMBERS :



Councilor Bane: Absent.



Councilor Manilla: Absent.



Councilor Scafella: Councilor Scafella addressed the Wiles Hill Night Out and the MPO desire for crosswalk by Brooks Hall. The DOH has already replaced each crosswalk on Beechurst Avenue.



Councilor Miller: Councilor Miller commended the Evansdale NHA on its' bylaws, thanked Wiles Hill for the Night Out and urged accommodating conventions like MountainFest..



Councilor Byrne: Councilor Byrne asked about the Boulevard lights and the trash task force; noted the South Hills NHA newsletter events; suggested developing a truck route and requested economic data from the CVB.



City Manager Boroff responded to the lights out issue.



Councilor Spencer: Councilor Spencer noted the problems with mid-block crosswalks; heard positive comments about MountainFest and commended Main Street and all the departments that were involved; saw the new 20-story apartment building as good news and requested discussion on underground utilities; appreciated the Code Enforcement report addendum; discussed care of delapidated properties, Capt. Hill's retirement as State requirement of 50 and out; congratulated Senators for PRT funding; and noted the passing of 3 people that had made major contributions to the city.

Mayor Justice: Mayor Justice thanked Wiles Hill for the Night Out; noted this is reporter Eric Bowen's last meeting; mentioned lights are out on S. University and the trash task force will meet in August; reported that the Don Knotts Celebration has been postponed for health issues; gave WVML meeting reminder reiterated the Suncrest BP station looks good; and relayed comments from the Main Street Director about downtown businesses and MountainFest.
