REGULAR MEETING FEBRUARY 4, 2003:
The regular meeting of the Common Council of the City of Morgantown was held in the Council Chambers on Tuesday, February 4, 2003, at 7:30 P.M.
PRESENT: Mayor Ron Justice, City Manager Dan Boroff, City Clerk Linda L. Little, Assistant City Manager Jeff Mikorski, City Attorney Steve Fanok and Council Members Ron Bane, Jim Manilla, Frank Scafella, Teresa Miller, Bill Byrne, Florence Merow.
The meeting was called to order by the Mayor.
APPROVAL OF MINUTES: Minutes from the regular meeting on January 21, 2003, were approved as printed.
CORRESPONDENCE:
Councilor Merow presented certificates to Suncrest Middle students with help from Mayor Justice and Councilors Bane and Manilla.
Mayor Justice summarized letters: Tim Ball's reply to Mark Nesselroad, Adelphia's channel lineup changes, and The Square at Falling Run about Rail/Trail extension.
PUBLIC HEARING -AMENDATORY ORDINANCE FOR "DEBT SERVICE COVERAGE RATIO" OF THE PARKING REVENUE BONDS, SERIES 2000:
Pursuant to a legal notice appearing in the Dominion Post, Mayor Justice called for a public hearing on the above referenced Ordinance.
There being no appearances or objections, Mayor Justice declared this hearing closed.

Pursuant to a legal notice appearing in the Dominion Post, Mayor Justice called for a public hearing on the above referenced Ordinance.

AN AMENDATORY ORDINANCE FOR "DEBT SERVICE COVERAGE RATIO" OF THE PARKING REVENUE BONDS, SERIES 2000: The following entitled Ordinance was presented for second reading:

Motion by Scafella, second by Byrne, to adopt the above entitled ordinance. Motion carried 7-0.
AN ORDINANCE AMENDING FY 2002-2003 ANNUAL BUDGET: The following entitled Ordinance was presented for second reading:

Motion by Byrne, second by Miller, to adopt the above entitled ordinance. Motion carried 7-0.
PUBLIC PORTION:
Bill Warnick, 817 Willowdale Road, spoke about speeding on Willowdale Road.
Jim Gaston, 725 Pyle Avenue, spoke about the Hart Field Coalition, the Airport budget, and a newspaper article about the Airport.
SPECIAL COMMITTEE REPORTS:
Councilor Byrne reported on the Solid Waste Umbrella Group and recycling; Councilor Scafella requested daily checking of daily garbage pickup areas.
Councilor Miller and City Clerk Little spoke about the Substance Abuse Task Force.
NEW BUSINESS:
AN ORDINANCE AMENDING SECTION 1511.99 OF THE FIRE PREVENTION CODE: The following entitled Ordinance was presented for first reading:

After discussion, motion by Miller, second by Byrne, to pass the above entitled ordinance to second reading. Motion carried 7-0.
AN ORDINANCE AMENDING SECTION 5 (20) OF THE ZONING ORDINANCE; AND AMENDING 17.1(3) TO ADD "G": The following entitled Ordinance was presented for first reading:
AN ORDINANCE AMENDING SECTION 5 (20) OF THE ZONING ORDINANCE OF THE CITY OF MORGANTOWN TO CHANGE THE DEFINITION OF FAMILY; AND AMENDING 17.1(3) TO ADD "G" AS THE SAME APPLIES TO THE REGULATION OF THE NUMBER OF PEOPLE THAT CAN OCCUPY RESIDENTIAL UNITS IN A PLANNED UNIT DEVELOPMENT (PUD) DISTRICT.

A RESOLUTION TO RECOMMEND THE APPLICATION FOR RECREATIONAL TRAILS PROGRAM GRANT FUNDING FOR CONSTRUCTION OF TRAILS TO CONNECT EXISTING TRAILS IN WHITE PARK IN THE AMOUNT OF $50,000: The above Resolution was presented for Council's approval:

A RESOLUTION TO RECOMMEND THE APPLICATION FOR RECREATIONAL TRAILS PROGRAM GRANT FUNDING FOR CONSTRUCTION OF TRAILS TO CONNECT EXISTING TRAILS IN KREPPS PARK IN THE AMOUNT OF $120,000: The above Resolution was presented for Council's approval:
Motion by Scafella, second by Byrne, to adopt the above entitled resolution. Motion carried 7-0.
A RESOLUTION TO RECOMMEND THE APPLICATION FOR RECREATIONAL TRAILS PROGRAM GRANT FUNDING FOR CONSTRUCTION OF TRAILS TO CONNECT EXISTING TRAILS IN MARILLA PARK IN THE AMOUNT OF $80,000: The above Resolution was presented for Council's approval:
Motion by Bane, second by Merow, to adopt the above entitled resolution. Motion carried 7-0.
CITY MANAGERS REPORT:

Item No. 1:
City Manager Boroff responded to Mr. Gaston about the comments by the Airport Director in the newspaper article.
NEW BUSINESS:
Item No. 1:
Attached you will find a contract with the Airport's contract engineer firm Alpha Associates to design, prepare bid specifications, inspect, and manage 5 new projects at the Airport totaling $1,142,000 (part of the 5 year Capital Improvement Plan approved by the FAA) for a fee of $141,536. Based upon the merits of the projects and the available Federal funds, I recommend the contract be approved.
After discussion, motion by Scafella, second by Bane, to approve the contract for Alpha Associates in the amount of $141, 536. Motion carried 4-3 (Bane, Manilla, Merow Voted NO).
Item No. 2:
The second attachment is a request from Mylan Laboratories, Inc. for the City to approve a change of its hanger/office manager at the Airport from Air Corp. Services, Inc. to MB Express, Inc. All the principals involved remain the same and are in agreement with the request. Based upon this concurrence, I recommend that the request be granted.
Motion by Byrne, second by Miller, to approve the change. Motion carried 7-0.

REPORT FROM COUNCIL MEMBERS :
Councilor Bane: Councilor Bane remarked about South Park lighting, Willowdale traffic, and gave thanks for support during grandfather's death.
Councilor Manilla: Councilor Manilla gave an update of the Truck Loading Zone program, commented on stop signs and questioned how the agenda is set up. Councilor Manilla asked how the City benefits from running the Airport and for more community input to the Airport.
Councilor Scafella: Councilor Scafella commented on McCullough Street parking, mirror now at Protzman helpful, Traffic Commission case for or against Willowdale stop sign, Airport committee and FBO history, and lighting for Willowdale and South Park.
Councilor Miller: Councilor Miller mentioned 2 requests to remove parking on McCullough and also desires a stop light there; the State Historical Commission needs clearer guidelines for historical designation for the Planning Commission to follow.
Councilor Byrne: Councilor Byrne commented on speeding on Vandalia, Altzheimer grant funding, neighborhood match for funding projects, and the truck loading issue. Councilor Byrne clarified Council as setting policy versus micro-management, and thanked Jimmy McCartney and the South Point Road Committee.
Councilor Merow: Councilor Merow noted the Beechurst project was City funded and commented on 3 versus 2 readings. Councilor Merow announced she will not run for re-election, thanked citizens for 27½ years in elected positions and endorsed Jim Shaffer for the 7th Ward.
Mayor Justice: Mayor Justice thanked Councilor Merow for her years of service, noted the work to get items on the agenda and asked the City Manager to research Commission versus City airports and educate Council on Airport history. Mayor Justice congratulated Terry Jones on his service to the community, challenged Council and the community to help raise money for Dorsey Knob, and noted the Metropolitan Theatre letter in packet.
