REGULAR MEETING NOVEMBER 19, 2002:
The regular meeting of the Common Council of the City of Morgantown was held in the Council Chambers on Tuesday, November 19, 2002, at 7:15 P.M.
PRESENT: Mayor Ron Justice, City Manager Dan Boroff, City Clerk Linda L. Little, Assistant City Manager Jeff Mikorski, City Attorney Steve Fanok and Councilmembers Ron Bane, Jim Manilla, Frank Scafella, Teresa Miller, Bill Byrne, Florence Merow.
The meeting was called to order by the Mayor.
APPROVAL OF MINUTES: Minutes from the regular meeting on November 6, 2002, were approved as printed.
CORRESPONDENCE:
Councilmembers presented Terrific Kids of the Month certificates to Woodburn Elementary students.
Mayor Justice commented on a proclamation for Mary Evans' 100th birthday.
PUBLIC HEARING-AMENDING SECTION 719.15 AS THE SAME APPLIES TO CHARITABLE SOLICITORS AND PERMIT REVOCATION:
Pursuant to a legal notice appearing in the Dominion Post, Mayor Justice called for a public hearing on the above referenced Ordinance.
There being no appearances or objections, Mayor Justice declared this hearing closed.
UNFINISHED BUSINESS:
AN ORDINANCE AMENDING SECTION 719.15 AS THE SAME APPLIES TO CHARITABLE SOLICITORS AND PERMIT REVOCATION: The following entitled Ordinance was presented for second reading:
AN ORDINANCE AMENDING SECTION 719.15 OF THE BUSINESS AND TAXATION CODE OF THE CITY OF MORGANTOWN AS THE SAME APPLIES TO CHARITABLE SOLICITORS AND PERMIT REVOCATIONS.
Motion by Byrne, second by Miller, to adopt the above entitled ordinance. Motion carried 7-0.
AN ORDINANCE AUTHORIZING ISSUING PARKING REVENUE BONDS NOT TO EXCEED $6,500,000 FOR THE WHARF DISTRICT PARKING GARAGE: The following entitled Ordinance was presented for second reading:
AN ORDINANCE AUTHORIZING THE ACQUISITION, CONSTRUCTION AND EQUIPPING OF NEW MOTOR VEHICLE PARKING FACILITIES, AND THE FINANCING OF THE COSTS THEREOF, NOT OTHERWISE PROVIDED, THROUGH THE ISSUANCE OF PARKING REVENUE BONDS, SERIES 2002, OF THE CITY IN THE AGGREGATE PRINCIPAL AMOUNT OF NOT TO EXCEED $6,500,000, THE PROCEEDS OF WHICH, TOGETHER WITH OTHER FUNDS OF THE CITY, SHALL BE EXPENDED FOR SUCH COSTS AND TO PAY COSTS IN CONNECTION WITH ISSUANCE OF SUCH BONDS; PROVIDING FOR THE RIGHTS AND REMEDIES OF, AND THE SECURITY FOR, THE REGISTERED OWNERS OF SUCH BONDS; AUTHORIZING THE EXECUTION AND DELIVERY OF OTHER DOCUMENTS IN CONNECTION THEREWITH; AUTHORIZING THE SALE AND PROVIDING FOR THE TERMS AND PROVISIONS OF SUCH BONDS AND ENACTING OTHER PROVISIONS WITH RESPECT THERETO.
After presentation by Tom Arnold, Parking Authority Director, and discussion, motion by Byrne, second by Miller, to pass the above entitled ordinance to third reading. Motion carried 7-0.

NEW BUSINESS:
AN ORDINANCE AUTHORIZING A LEASE AGREEMENT WITH MYLAN LABORATORIES FOR HANGER AND OFFICE SPACE AT THE AIRPORT: The following entitled Ordinance was presented for first reading:
AN ORDINANCE AUTHORIZING A LEASE AGREEMENT BY AND BETWEEN THE CITY OF MORGANTOWN (LESSOR) AND MYLAN LABORATORIES, INC. (LESSEE), AS IT PERTAINS TO MYLAN LEASING HANGER AND OFFICE SPACE AT THE MORGANTOWN MUNICIPAL AIRPORT FROM THE CITY OF MORGANTOWN.
After discussion, motion by Merow, second by Bane, to pass the above entitled ordinance to second reading. Motion carried 7-0.
AN ORDINANCE ENACTING SECTION 129.13 OF THE MORGANTOWN CITY CODE, WHICH WILL ALLOW THE PAYMENT OF TAXES, FEES, ASSESSMENTS, AND OTHER MONEY DUE THE CITY BY CREDIT CARD: The following entitled Ordinance was presented for first reading:
AN ORDINANCE ENACTING SECTION 129.13 OF THE MORGANTOWN CITY CODE, WHICH WILL ALLOW THE PAYMENT OF TAXES, FEES, ASSESSMENTS, AND OTHER MONEY DUE THE CITY BY CREDIT CARD.
After discussion, motion by Byrne, second by Merow, to pass the above entitled ordinance to second reading. Motion carried 7-0.
CITY MANAGERS REPORT:

November has been an extraordinary month for the City of Morgantown in terms of economic development in two regards. The first is the passage of Amendment 1 allowing tax increment financing. Already several opportunities have been identified where this new tool may make excellent projects possible that otherwise would not be feasible. As they mature, I will keep you advised. The second big event this month is the announcement of three, state economic development grants totaling approximately $20,000,000. The addition of the West Virginia Public Theater Complex to River Front Morgantown and the construction of West Virginia University Research and Development Park within the City are projects of the first order for the entire State. Along with recent announcements concerning the University Hospital Campus, residential buildings, and new commercial investments, these activities collectively define an era of extraordinary economic prosperity for Morgantown.
NEW BUSINESS:

For the past several years the City has worked closely with the Center for Black Culture and Research to celebrate Martin Luther King, Jr. Day in Morgantown. To further advance this initiative, I recommend that the City become a joint sponsor of the celebration and make available $2,000 from the Capital Escrow Account to help fund the programs that will be presented this coming year.
Motion by Miller, second by Byrne, to jointly sponsor Martin Luther King, Jr. Day by funding programs with $2,000. Motion carried 7-0.

REPORT FROM COUNCIL MEMBERS :
Councilor Bane: Councilor Bane commented on the mock disaster last week, commended Dave Custer for his work, and voiced problems with Monongahela Boulevard lighting.
Councilor Manilla: Councilor Manilla noted graffiti by the Trail, suggested contacting the ABC regarding violence at Elements, and proposed more sidewalk lighting.
Councilor Scafella: Councilor Scafella commented on a sidewalk lighting study.
Councilor Miller: Councilor Miller noted no November COW meeting and thanked board and commission volunteers and welcomed Councilor Merow back.
Councilor Byrne: No Report.
Councilor Merow: Councilor Merow thanked everyone for their letters and cards.
Mayor Justice: Mayor Justice commented on the mock disaster, echoed no COW meeting, and mentioned employee bonuses.
Motion by Miller, second by Bane, for holiday bonuses for city employees.
Mayor Justice mentioned a sidewalk issue being addressed and extended sympathy to the family of volunteer Liz Miranov.
