REGULAR MEETING OCTOBER 21, 2003:



The regular meeting of the Common Council of the City of Morgantown was held in the Council Chambers on Tuesday, October 21, 2003, at 7:30 P.M.

PRESENT: Mayor Ron Justice, City Manager Dan Boroff, City Clerk Linda L. Little, Assistant City Manager Jeff Mikorski, City Attorney Steve Fanok and Council Members Ron Bane, Jim Manilla, Frank Scafella, Teresa Miller, Bill Byrne, Don Spencer.



The meeting was called to order by the Mayor.



APPROVAL OF MINUTES: Minutes of the regular meeting on October 7, 2003, were approved as printed.

CORRESPONDENCE:



Mayor Justice noted a thank you from WVU Research Park, read a proclamation for National Weatherization Day and, with Councilor Byrne and Tom Arnold of the Parking Authority, presented a proclamation and award to Barton Loar.



Jan Derry, NWVCIL, invited Council members to their 10th Anniversary dinner and celebration.



Mayor Justice welcomed Misty Poe Phillips as the new Dominion Post reporter.

PUBLIC HEARING - ANNULLING ONE HUNDRED FIFTEEN FEET OF A TWELVE FOOT WIDE UNNAMED ALLEY BETWEEN BEVERLY AVENUE AND ANOTHER UNNAMED ALLEY IN THE 4TH WARD:



Pursuant to a legal notice appearing in the Dominion Post, Mayor Justice called for a public hearing on the above referenced Ordinance.



There being no appearances or objections, Mayor Justice declared this hearing closed.

UNFINISHED BUSINESS:

AN ORDINANCE ANNULLING ONE HUNDRED FIFTEEN FEET OF A TWELVE FOOT WIDE UNNAMED ALLEY BETWEEN BEVERLY AVENUE AND ANOTHER UNNAMED ALLEY IN THE 4TH WARD: The following entitled Ordinance was presented for second reading:



AN ORDINANCE VACATING, ABANDONING AND ANNULLING A TWELVE FOOT WIDE UNNAMED ALLEY, RUNNING A DISTANCE OF APPROXIMATELY ONE HUNDRED AND FIFTEEN FEET FROM BEVERLY AVENUE TO ANOTHER UNNAMED ALLEY IN THE FOURTH WARD OF THE CITY OF MORGANTOWN, MONONGALIA COUNTY, WEST VIRGINIA, NOT USED NOR USEFUL FOR STREET PURPOSES.

Motion by Bane, second by Byrne, to adopt the above entitled Ordinance. Motion carried 7-0.



AN ORDINANCE AMENDING THE FY 2003-2004 ANNUAL BUDGET: The following entitled Ordinance was presented for second reading:



AN ORDINANCE AMENDING THE FY 2003-2004 ANNUAL BUDGET OF THE CITY OF MORGANTOWN AS SHOWN IN THE REVISED BUDGET ATTACHED HERETO AND MADE A PART OF THIS ORDINANCE AS APPLIES TO THE GENERAL FUND.

Motion by Scafella, second by Spencer, to adopt the above entitled Ordinance. Motion carried 7-0.



BOARDS AND COMMISSIONS:

By acclamation, Councilor Scafella was appointed to the Historic Landmarks Commission.



PUBLIC PORTION:

There being no appearances or objections, Mayor Justice declared the Public Portion closed.

SPECIAL COMMITTEE REPORTS:



Councilor Byrne reported on the Sunnyside Up focus groups, Councilor Spencer announced the Dorsey Knob Park opening and Mayor Justice mentioned a Solid Waste Task Force meeting.



NEW BUSINESS:



AN ORDINANCE AMENDING SECTIONS 929.01, 929.20, 929.21, AND 929.22 AS THE SAME APPLY TO STORMWATER: The following entitled Ordinance was presented for first reading:



AN ORDINANCE AMENDING SECTIONS 929.01, 929.20, 929.21, AND 929.22 OF THE MORGANTOWN CITY CODE, AS THE SAME APPLY TO STORMWATER MANAGEMENT AND DRAINAGE, STORMWATER DESIGN, AND PLAN SUBMISSION AND REVIEW.



The rules were suspended to allow Tim Ball to answer questions.



Motion by Miller, second by Byrne, to pass the above entitled Ordinance to second reading. Motion carried 7-0.



A RESOLUTION TO APPLY FOR A $5,000 GRANT FOR THE ROSENBAUM FAMILY HOUSE FOR UPGRADES OF COMPUTER AND STORAGE EQUIPMENT: The above entitled Resolution was presented for Council's approval.



Motion by Miller, second by Byrne, to pass the above entitled Resolution. Motion carried 7-0.



A RESOLUTION ACCEPTING A GRANT OF $10,000 FOR MOUNTAIN LINE TRANSIT TO PROCURE A FACILITY BUILDING: The above entitled Resolution was presented for Council's approval.



Motion by Byrne, second by Scafella, to pass the above entitled Resolution. Motion carried 7-0.



A RESOLUTION ACCEPTING A GRANT OF $10,000 FOR THE WALKING TOUR PROGRAM OF MAIN STREET MORGANTOWN: The above entitled Resolution was presented for Council's approval.



Motion by Scafella, second by Miller, to pass the above entitled Resolution. Motion carried 7-0.



A RESOLUTION ACCEPTING A GRANT OF $10,000 FOR THE PRESERVATION ALLIANCE OF WEST VIRGINIA "FRONTIERS TO MOUNTAINEERS" PROJECT: The above entitled Resolution was presented for Council's approval.



Motion by Scafella, second by Miller, to pass the above entitled Resolution. Motion carried 7-0.

REPORT FROM COUNCIL MEMBERS:



Councilor Bane: Councilor Bane commented on Dorsey Avenue traffic signs and speeding, and that towing companies are regulated by the Public Service Commission and how to contact the commission.



Councilor Manilla: Councilor Manilla requested discussion of downtown garbage pick up and lower Walnut Street area ideas at the COW. Councilor Manilla noted quick police response, thanked Linda Little for MMCA report, and urged urban sprawl regulations with County.



Councilor Scafella: Councilor Scafella covered the BFI pick up schedule with the Wednesday night football game, that over $100,000 worth of playground equipment was donated to BOPARC by a Waynesburg facility, and he will bring the Wiles Hill gazebo photographs.

Councilor Miller: No Report.



Councilor Byrne: Councilor Byrne addressed the number of property code violation citations reported, Brockway Avenue as a blight and slum, use of annual entitlement money for slum and blight, vacant and condemned buildings, and taxation issues for cities.



Councilor Spencer: Councilor Spencer asked when the legislators will visit, urged trash citation copy to property owner, noted the condition of 3BT property on Burroughs, asked about a trash on the river resolution and right turn on red at Spruce and Pleasant, and complimented BOPARC and the Clark's concert event.



Mayor Justice: Mayor Justice explained why there was no right turn on red at Spruce and Pleasant, commented on moving forward on 2 projects from the grant committee since the Supreme Court decision, listed future meetings and events, the new MPO Director is Chet Parsons, thanked City employees for preventive work before the football game, and addressed the Halloween editorial.
