REGULAR MEETING OCTOBER 18, 2005:



The regular meeting of the Common Council of the City of Morgantown was held in the Council Chambers on Tuesday, October 18, 2005, at 7:30 P.M.

PRESENT: Mayor Ron Justice, City Manager Dan Boroff, City Clerk Linda Little, City Attorney Steve Fanok, Assistant City Manager Jeff Mikorski, and Council Members Ron Bane, Jim Manilla, Frank Scafella, Teresa Miller, Bill Byrne, Don Spencer.



The meeting was called to order by the Mayor.



APPROVAL OF MINUTES: Minutes from the regular meeting on October 4, 2005, were approved as amended.



CORRESPONDENCE:



Mayor Justice summarized a DOT Order extending the service obligation of Mesa Air Group; letters about the code-share agreement between Regions Air and Delta Airlines, truck traffic e-mail, a Clay Street project issues letter, and mentioned Municipal Government Week. Councilor Byrne commented on the Airport Director retiring, Regions Air and Delta Airlines, and truck traffic to be on COW agenda. Mayor Justice presented the NLC certificate of recognition for WVML All-Star Community Award.



PUBLIC HEARING-AN ORDINANCE AUTHORIZING A LEASE AGREEMENT WITH FLIGHT SOURCE, LLC, AT THE AIRPORT:



Pursuant to a legal notice appearing in the Dominion Post, Mayor Justice called for a public hearing on the above referenced Ordinance.



There being no appearances or objections, Mayor Justice declared this public hearing closed.



UNFINISHED BUSINESS:



AN ORDINANCE AUTHORIZING A LEASE AGREEMENT WITH FLIGHT SOURCE, LLC, AT THE AIRPORT: The following entitled Ordinance was presented for second reading.



AN ORDINANCE AUTHORIZING A LEASE AGREEMENT BY AND BETWEEN THE CITY OF MORGANTOWN, LESSOR, AND FLIGHT SOURCE, LLC, LESSEE, REGARDING THE LEASE OF BUSINESS SPACE AT THE MORGANTOWN MUNICIPAL AIRPORT.

After explanation by the City Manager, motion by Scafella, second by Byrne, to adopt the above Ordinance. Motion carried 7-0.



BOARDS AND COMMISSIONS:



Request by Councilor Spencer for the City Attorney to search again about non-voting associate members on commissions. Councilor Bane advised of a City Council portion on MUB agendas.



PUBLIC PORTION:



The rules were suspended to allow Rich Lane of Petroplus & Associates and Paul Walker & Dave Weaver of Paradigm to present information on the Waterfront Marina Project.



There being no more appearances or objections, Mayor Justice declared this public portion closed.



SPECIAL COMMITTEE REPORTS:



Mayor Justice requested the Burroughs Run project be on the COW.



NEW BUSINESS:



CONSIDERATION OF APPROVAL OF A RESOLUTION TO OBTAIN $3,000 FOR THE MOUNTAINEER KENNEL CLUB, A 501(c) 7 ORGANIZATION WHICH HAS BEEN LISTED AS A LEGISLATIVE BUDGET DIGEST PROJECT: The above entitled Resolution was presented for Council's approval.



Motion by Bane, second by Scafella, to approve the above Resolution. Motion carried 7-0.



CITY MANAGERS REPORT:



NEW BUSINESS:

Item No. 1:

Attached is a letter from the 201st Infantry/Field Artillery Association requesting $2,720 to help improve the Association's memorial site on State Route 705. Given the rich heritage of the 201st Field Artillery in Morgantown and the significance of the site as an entry way to the City, I recommend that the request be granted from the Capital Escrow Account.



After discussion, motion by Manilla, second by Byrne, to approve $2,720 from the Capital Escrow Account to improve the 201st memorial site on State Route 705. Motion carried 7-0.



Item No. 2:

The second attachment describes an invitation to the Morgantown High School Chamber Choir to perform at Carnegie Hall in March of next year and a request for funds to help support related expenses. Given the uniqueness of this opportunity and the excellent representation of the City of Morgantown, I recommend that $2,000 be granted to the organization from the Capital Escrow Account.



Motion by Scafella, second by Byrne, to grant the $2,000 request. Motion carried 7-0.

CITY ATTORNEY'S REPORT:

REPORT FROM COUNCIL MEMBERS:



Councilor Bane: Councilor Bane noted calls about Lambert Street parking and possible handicapped space there.



Councilor Manilla: Councilor Manilla announced the area Grey Line bus to the Pittsburgh Greyhound terminal and airport, the unanimous decision to televise Transit meetings, and a light out at Park and Greenbriar Streets.



Councilor Scafella: Councilor Scafella advised of historical research for Pietro contributions and welcomed Tony Antonini on the Historic Landmarks Commission; noted the lot was graded for Wiles Hill Park and requested some yellow lines in Third Ward.



Councilor Miller: Councilor Miller noted all the Monongahela Blvd. lights are on.

Councilor Byrne: Councilor Byrne discussed the NLC Home Program and the local group to attend, had a request for bus service to the South Hills area, and requested the truck ordinance move to the November COW.

Councilor Spencer: Councilor Spencer attended the Farmland Preservation Forum and requested that it and the S. University gateway, the zoning ordinance, the truck ordinance, and City legislative items be on COW agenda; asked for status report on new fire station; appreciates the efforts to keep Greyhound service; announced SNA meeting and park work days; and asked for update on MUB stormwater work.

Mayor Justice: Mayor Justice and Councilor Bane attended the Lights on Afterschool program; by acclamation, Mon River Boat Tour was scheduled on November 5; and announced future meetings and events.
