MINUTES

October 17, 2001

CALL TO ORDER

Members Present: T. Shamberger, J. Rockis, and G. Pastoria

Members Absent: N. Iannone and R. Hawkins

Staff Present: Jim Wood, Planning Director

 

MATTERS OF BUSINESS:

T. Shamberger made a motion to approve the minutes as written, seconded by J. Rockis. Motion approved unanimously.

 

OLD BUSINESS:

V01-05 / Domino’s Pizza / 300 Pleasant Street: Request by Domino’s Pizza for variance approval for signage in excess of 72 square feet in a B-4 District. Tax Map #29, Parcel #369, a B-4, General Business District.

J. Wood read the variance and conditional use staff reports. He stated Domino’s Pizza had made application to modernize their signs to bring the franchise up to date. He also added that Domino’s would like to replace their existing non-conforming signage, which currently consists of a wall sign and a pole sign, with a new wall sign and a monument style sign.

He added that proposed wall sign facing Cobun Street would be 35.2 square feet, exceeding the twelve (12) square foot threshold for a conditional use by 23.2 square feet. He further stated that the proposed monument style sign is approximately ____ feet, including the menu board. J. Wood also added that the Design Review Committee voted unanimously to approve the new design with the exception of the menu board, which they believed is inappropriate for a historic district.

Paul Callihan, owner, stated that the reader board is very important to the marketing scheme for Domino’s Pizza.

G. Pastoria asked the applicant if he considered putting the menu board on the main building. The applicant stated that he did not. Discussion ensued on the importance of a reader board and advertising.

G. Pastoria asked for public comment. There was none.

G. Pastoria closed the public hearing on this item.

G. Pastoria read the findings of fact. J. Wood added that the property is unusual in that the applicant is proposing to improve the existing non-conforming signs

Discussion ensued on reader boards for restaurants in the downtown district. All findings of fact questions were found in the positive.

T. Shamberger made a motion to approve the variance not to exceed forty (40) square feet more than the ordinance allows, seconded by J. Rockis. Motion approved unanimously.

 

CU01-11 / Domino’s Pizza / 300 Pleasant Street: Request by Delta Sign Company for conditional use approval for a signage in excess of 12 square feet in a B-4 District and for a free standing sign at 300 Pleasant Street. Tax Map #29 Parcel #369, a B-4 General Business District.

J. Wood stated that Domino’s Pizza is requesting conditional use approval for the freestanding monument sign.

G. Pastoria read the findings of fact. All were found in the positive.

J. Rockis made a motion to approve the conditional use request with the condition that the existing pole and wall sign be removed, seconded by T. Shamberger. Motion approved unanimously.

 

NEW BUSINESS:

CU01-23 / Scott Davis / Home Occupation: Request by Scott Davis for conditional use approval for home occupation to begin teaching Kung Fu at 1004 Willey Street. Tax Map # 25, Parcel # 177, an R-2, Single-family, Two-family Residential District.

J. Wood read the staff report. He stated that the applicant would teach Kung Fu classes on Sunday evenings. He also added that the classes would be taught in the rear yard of his residence, to no more than 1-2 students at a time, and that he has ample parking.

Scott Davis presented his request to the Board. He stated that he would like to start this home occupation as a tax write-off.

 

G. Pastoria asked for public comment. There was none.

G. Pastoria closed the public hearing on this item.

J. Rockis made a motion to accept the finding of facts as written by the applicant, seconded by T. Shamberger. Motion approved unanimously.

G. Pastoria made a motion to approve the conditional use request for home occupation, seconded by T. Shamberger. Motion approved unanimously.

 

OTHER BUSINESS

Public Comments

Staff Comments: J. Wood updated the Board on the proposed zoning rewrite. He stated that members of the Planning Commission would interview consultants.
