MINUTES

November 28, 2001

CALL TO ORDER

Members Present: N. Iannone, T. Shamberger, R. Hawkins and J. Rockis, G. Pastoria

Members Absent: None

Staff Present: Jim Wood, Planning Director

 

MATTERS OF BUSINESS:

J. Rockis made a motion to approve the minutes as written, seconded by T. Shamberger. Motion approved unanimously.

 

OLD BUSINESS: NONE

 

NEW BUSINESS:

V01-09 / Mayer / Charles Avenue: Request by Roger Mayer for variance approval from Zoning Ordinance §14.B.4.b., Accessory Buildings and Uses, in order to construct an accessory building in the side yard for property located at the corner of Rt. 119 and Charles Avenue. Tax Map #21, Parcel #39, an R-1, Single-family Residential District.

J. Wood read the staff report. He stated the applicant is proposing to build a detached garage in the side yard of his residence.

Roger Mayer presented his request to the Board.

R. Hawkins clarified that the future house would have a three-car garage, but that the applicant wanted the additional garage for storage and a wood shop.

J. Rockis agreed with the applicants reasoning.

T. Shamberger stated that the property is unsuitable for a garage in the rear quarter.

R. Hawkins asked if the zoning ordinance speaks of the number of stalls allowed in a garage.

J. Wood stated that the ordinance did not speak on a limitation.

G. Pastoria asked for public comment.

Joetta Moore, neighbor, stated that she is not objecting, but would just like clarification on the proposed accessory building.

Roger Mayer stated that the attached garage would only have two garage doors, one singe and one double. He also added that no cars would be in the accessory building.

G. Pastoria closed the public hearing.

R. Hawkins asked if the applicant intendeds to rent the upstairs of the proposed garage as living space.

J. Wood stated that the applicant would not be permitted to use the area as rental property.

T. Shamberger made a motion to accept written findings of fact as written by applicant, seconded

by R. Hawkins. Motion passed unanimously.

R. Hawkins made a motion to approve the request, seconded by J. Rockis. Motion passed

unanimously.
