Staff Present: Jim Wood, Planning Director.
Election of Chair and Vice-Chair and approval of November and December minutes were deferred to the February meeting.

Solomon /
J. Wood read the staff report stating that that Ms. Solomon is seeking permission for off
premise parking due to the placement of a 2,815 square foot temporary office
facility, an accessory use for the

Wood explained that Article 12.B.6 – Off-Street Parking and Loading Requirements, states that “In Business, Industrial, and Multi-family Districts, the Board of Zoning Appeals may grant conditional use approval to provide required parking spaces on a site that is: 1) within 300 feet of the principal use and 2) within a District that permits public parking lots as a permitted or conditional use”. The proposed off-site parking meets these criteria.
J. Wood observed that the Technical Review Committee has approved the temporary structure and staff recommends approval as requested with the condition that there be a time limit on the utilization of the temporary parking lot of no more than three years.
Steve Solomon, SBS Properties, stated the hospital needed space to directly connect all the PCs the to the mainframe computers.
B. Bossio asked if the three year lease had been executed.
Mr. Solomon replied that it had not, just discussion until after the approvals.
B. Bossio questioned if O-I should be included in the list under Article 12.b.6.
J. Wood replied that O-I is considered as part of Industrial.
R. Hawkins asked for public comments. There being none, the public portion was closed.
J. Wood gave a correction to the Findings of Fact narrative, changing five years to three years.
Motion by B. Bossio to approve the Findings of Fact as written, second by N. Iannone. Motion carried unanimously.

Bucklew /
J. Wood read the staff report stating that. Robert Bucklew would like approval for off premise parking utilizing excess parking stalls, behind the existing G&B Quick Mart, for the upstairs expansion of Buck’s Place Bar. Mr. Bucklew currently has 10 parking spaces around the perimeter of Buck’s Place; these spaces serve the downstairs portion of the bar. The applicant would like to reopen the top floor of the bar and is required to provide 14 spaces to handle the additional square footage. He intends to provide these on a graveled lot adjacent to Buck’s Place, behind the convenience store, an area approximately 100 to 150 feet from the bar. These stalls will have to be designated in some way with wheel stops and/or installation of anchored landscape timbers.
J. Wood clarified that the parking equation for such an establishment is one space for each 75 square feet of gross floor space where the public is served, plus an additional 10% of the off-street parking required for employees. The lease with G&B Corporation, Inc. will run through December 2014. Staff recommends approval with the following condition:
1. Each stall be a minimum of 9’ X 18’ in size and be delineated with wheel stops and/or landscape timbers anchored into the ground.
Bob Bucklew, Buck’s Place, has been using the same parking lots since 1981 and railroad ties were there until they rotted away about a year ago.
R. Hawkins asked for public comments. There being none, the public portion was closed.
The Findings of Fact were approved separately. The word “safety” in the applicant’s response
to finding number 2 was changed to ”risk”; The phrase “No additional
construction is involved and when the existing business (Quick Mart) closes,
its parking becomes available” was substituted for the applicant’s response in
finding number 4. Finding number 5 was
altered to add “in that it would parking off of

Glenmark Holdings / 1460Earl
J. Wood read the staff report stating that Glenmark
Holdings, LLC for conditional use approval for signage in excess of 100 square
feet at the entrance to the plaza being constructed at
J. Wood explained that the way the zoning ordinance is currently structured, the applicant could erect multiple free-standing signs, each less than 100 square feet, without any hearings. The Board of Zoning Appeals can attach whatever conditions deemed appropriate to this case. One example of a condition might be to state that no other free-standing signs may be utilized for this development if this requested sign is approved. Other conditions that can be considered include limiting the number and size of wall signs for individual tenants. The Planning Commission recommends approval and asks that the Board of Zoning Appeals attach a condition no other free-standing signs be permitted on the property, regardless of size.
J. Wood advised that the Board of Zoning Appeals must find that A) the proposed sign is within the fitting character of the surrounding area; B) the proposed sign permits adequate natural light, adequate ventilation and adequate wind flow to adjoining properties; C) the proposed sign creates no traffic hazard by obstructing sign zones or by intensely attracting the driver’s attention away from the roadway or travel way; D) the proposed sign is aesthetically suitable to the surrounding area; and E) the proposed sign does not cause an undue concentration of signs.
Steve Brock, City Neon, agreed with the staff report.
B. Bossio questioned how the sign was measured.
J. Wood replied that the sizes of the individual sign panels were totaled.
R. Hawkins asked for public comments. There being none, the public portion was closed.
The Findings of Fact were approved separately. In finding number 2, the word “several” was changed to “dozens”. In finding number 3, the words “sight distance triangles” were added to the applicant’s response. Finding number 4 was changed to add, “it will be consistent with 80% of signs in the area.” Finding number 5 was altered to read “the only free-standing sign for this development and dozens of yards from any other signs.” To finding number 6, the words “and will not obstruct either foot or vehicle traffic.” Were added to the applicant’s response.
Motion by N. Iannone to approve the Findings of Fact as amended, second by B. Bossio. Motion carried unanimously.
Motion by B. Bossio to approve the request with the following conditions: no more free-standing signs on the property, sign must be constructed with the same panel configuration as shown and no larger than shown, and sign may not have any off-premise advertising on it. Second by N. Iannone. Motion carried unanimously.
